Catherine Herridge
High-level Justice Department discussions about a reported offer by Deputy Attorney General (DAG) Rod Rosenstein to secretly record President Trump took place over a “couple of days” before the idea was abandoned as “too risky,” according to testimony from the FBI's former top lawyer.
Former FBI General Counsel James Baker, in closed-door testimony before congressional committees last October, provided detail about internal discussions concerning Rosenstein's reported offer to wear a wire to tape the president in the tumultuous days following James Comey’s firing as FBI director in May 2017.
Fox News has confirmed portions of the transcript to the House Oversight and Judiciary Committees. The transcript provided additional insight into discussions that have returned to the spotlight in Washington as now-fired Acting FBI Director Andrew McCabe has revisited the matter during interviews promoting his forthcoming book.
"I never did a legal analysis of this matter because after the conversation came up it was quickly dismissed,” Baker testified.
Pressed on who dismissed the reported wire proposal, Baker said: “A, I don’t know, but, B, my belief is that it was just not something that made any sense to do. It was too risky. It just would not pay the benefits. It wouldn’t obtain the information that they thought it would obtain, so it just was one of these things that didn’t make sense from a commonsense perspective, despite any legal analysis."
Pressed on how long the wire issue was discussed, Baker said, "...A couple of days or something, yes.”
Baker said he met contemporaneously with McCabe, and his bureau lawyer Lisa Page, about their conversations with Rosenstein. The reported offer to record the president was billed as an effort to gather evidence as part of an obstruction-of-justice case against the president for firing Comey.
McCabe told CBS News' "60 Minutes," in an interview broadcast Sunday, that Rosenstein "offered to wear a wire into the White House. He said, 'I never get searched when I go into the White House. I could easily wear a recording device. They wouldn’t know it was there.'"
However, McCabe said of his former colleague and legal adviser, "I think the general counsel (Baker) had a heart attack. And when he got up off the floor, he said, 'I, I, that’s a bridge too far. We’re not there yet.'"
Baker, who could face criminal penalties for lying or misleading congressional investigators, also detailed alleged discussions among senior Justice Department officials about invoking the 25th Amendment to remove President Trump from office, claiming he was told Rosenstein said two Trump Cabinet officials were “ready to support” such an effort.
“I was being told by some combination of Andy McCabe and Lisa Page, that, in a conversation with the Deputy Attorney General, he had stated that he -- this was what was related to me -- that he had at least two members of the president’s Cabinet who were ready to support, I guess you would call it, an action under the 25th Amendment,” Baker told the committees.
On Thursday, the Justice Department issued a statement that said Rosenstein rejected McCabe’s recitation of these events “as inaccurate and factually incorrect.” It also denied that Rosenstein ever OK'd wearing a "wire" to tape Trump.
“The deputy attorney general never authorized any recording that Mr. McCabe references,” the statement said. “As the deputy attorney general previously has stated, based on his personal dealings with the president, there is no basis to invoke the 25th Amendment, nor was the DAG in a position to consider invoking the 25th Amendment.”
And, on Monday, a department official again pushed back against McCabe and his claim that Rosenstein initially resisted appointing a Special Counsel because he was concerned about his future and whether he would lose his job. A senior Justice Department official said, "The special counsel was appointed to ensure that the Russia investigation was truly independent and without bias, something that McCabe could not have accomplished."
During his testimony, Baker acknowledged he was not directly involved in the May 2017 discussions but testified over a two-day period in October that McCabe and Page relayed to him details about their conversations with Rosenstein.
As Fox News has reported previously, the eight days in May 2017 between Comey’s firing and appointment of Special Counsel Robert Mueller were seen as a major turning point in the Russia probe, which also has involved examining whether the president obstructed justice.
In October, during a separate closed-door interview, Sally Moyer, another senior FBI lawyer who soetimes commuted to work with Page, described Page’s private reaction to the claim that Rosenstein’s comments were sarcastic.
“It was when the news hit about the wiretap and the department’s position and what they were saying happened, and she was indicating she did not believe that they were telling the truth,” Moyer said.
Also during the testimony, Moyer said the chances of securing a 2016 surveillance warrant for a Trump campaign aide were only “50/50” without the controversial anti-Trump “dossier,” according to transcripts confirmed by Fox News.
Moyer’s testimony appeared to underscore how critical the dossier -- funded by the Democratic Party and Clinton campaign -- was in obtaining the Foreign Intelligence Surveillance Act (FISA) warrant, and appeared to conflict with Democratic assertions that the dossier played a limited role in the process.
Asked whether the FBI would have been able to establish probable cause if the application “did not have the Christopher Steele information in it,” Moyer responded: "So I think it's a close call, like 50/50, 51/49. I really think it's a close call." Steele, a British ex-spy, compiled the dossier.
Fox News reached out to all of the parties. The FBI and McCabe’s spokesperson declined to comment.
https://www.foxnews.com/politics/talks- ... awyer-saysTrump accuses Rosenstein, McCabe of pursuing ‘illegal and treasonous’ plot against presidency
Trump on Monday accused Deputy Attorney General Rod Rosenstein and former FBI Deputy Director Andrew McCabe of pursuing an “illegal and treasonous” plot against him, after McCabe detailed private DOJ discussions about secretly recording and potentially ousting the president.
The alleged discussions have been a subject of fierce debate – and conflicting accounts – for months. But McCabe revived the issue during promotional interviews for his forthcoming book, telling CBS News' "60 Minutes" that Rosenstein was “absolutely serious” when he suggested recording Trump in the tumultuous days following James Comey's firing as FBI director.
Trump seethed on Twitter over the comments, calling McCabe a liar before lashing out at top DOJ and FBI officials, including ousted Attorney General Jeff Sessions, for what he described as a “deranged” plan.
“He and Rod Rosenstein, who was hired by Jeff Sessions (another beauty), look like they were planning a very illegal act, and got caught … There is a lot of explaining to do to the millions of people who had just elected a president who they really like and who has done a great job for them with the Military, Vets, Economy and so much more. This was the illegal and treasonous ‘insurance policy’ in full action!” he tweeted.
Wow, so many lies by now disgraced acting FBI Director Andrew McCabe. He was fired for lying, and now his story gets even more deranged. He and Rod Rosenstein, who was hired by Jeff Sessions (another beauty), look like they were planning a very illegal act, and got caught.....
“Insurance policy” is a reference to texts between former FBI officials Peter Strzok and Lisa Page discussing such a policy, without elaborating – the text was widely suspected of referring to aspects of the Russia collusion probe.
While Trump fumed at McCabe, the former FBI deputy director claimed he "never actually considered taking [Rosenstein] up on the offer." He said he did discuss the matter with the FBI's then-general counsel, James A. Baker. Last fall, as reported by Fox News, Baker told lawmakers during a closed-door deposition that McCabe and Page came to Baker "contemporaneously" and told him details of the meeting where Rosenstein made the comments. Baker told congressional investigators he took the word of McCabe and Page "seriously."
McCabe told CBS News that "I think the general counsel had a heart attack" when he told him of Rosenstein's plan.
"And when he got up off the floor, he said, 'I, I, that's a bridge too far. We're not there yet,'" McCabe added. Days later, Rosenstein appointed former FBI Director Robert Mueller as a special counsel to oversee the bureau's investigation into allegations of collusion between the Trump campaign and Russian officials.
Rosenstein repeatedly has denied he "pursued or authorized recording the president" and also has denied McCabe's suggestion that the deputy attorney general had broached the idea of invoking the Constitution's 25th Amendment, which allows Cabinet members to seek the removal of a president if they conclude that he or she is mentally unfit. The Justice Department echoed both denials in a statement released last week, saying Rosenstein "was not in a position to consider invoking the 25th Amendment."
Yet McCabe said in the interview, "Rod raised the [25th Amendment] issue and discussed it with me in the context of thinking about how many other Cabinet officials might support such an effort.” He added that he believed Rosenstein was "counting votes or possible votes" to remove Trump from office.
Fox News reported Sunday that Baker, in his testimony to Congress, provided even more details about the alleged 25th Amendment discussions – saying two Cabinet officials were “ready to support” such an effort.
